3. Australian Consumer Law Compliance
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms is intended to limit, exclude, or modify any rights or remedies you may have under the ACL or any other applicable consumer protection legislation. To the extent any provision of these Terms conflicts with the ACL, the ACL prevails.
4. Products and Descriptions
We make every effort to ensure product descriptions, images, and sizing information on our website are accurate. However, colours may appear differently depending on your device screen settings. If you receive a product that is significantly different from its description on our website, you may be entitled to a remedy under the ACL.
We reserve the right to limit quantities, discontinue products, and correct any errors in product listings at any time without prior notice.
5. Orders and Payment
An order is not accepted until we send you an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including product unavailability, pricing errors, or suspected fraudulent activity.
All prices are listed in Australian Dollars (AUD) unless otherwise stated. For international orders, your bank or payment provider may apply currency conversion fees or international transaction charges, which are your responsibility.
We accept payments securely through Squarespace Payments, including Visa, Mastercard, and American Express, as well as Apple Pay, Google Pay, Afterpay, Klarna, and Link. A range of international card networks (including Discover, Diners Club, JCB, and UnionPay) is also accepted. By providing payment details, you confirm you are authorised to use that payment method.
Some items are available for pre-order. For pre-order items, full payment is taken at the time of order, and dispatch typically occurs within approximately 4–6 weeks. Full pre-order terms — including timeframes, delays, mixed orders, and cancellation — are set out in our Shipping and Delivery Policy.
6. Pricing
All prices include GST for Australian orders. International orders are exclusive of any customs duties, import taxes, or fees imposed by the destination country, which are the sole responsibility of the customer.
We reserve the right to change prices at any time. Any changes will not affect orders already confirmed.
7. Shipping and Delivery
Please refer to our separate Shipping and Delivery Policy for full details on delivery timeframes, costs, and methods.
8. Consumer Guarantees — Returns, Refunds, and Exchanges
Under the ACL, you have the right to a remedy if a product you purchase from us is not of acceptable quality, does not match the description provided, is not fit for a disclosed purpose, or does not comply with any express warranty we made.
8.1 Major Failures
A major failure is a serious problem that would have stopped you from buying the product had you known about it, or that makes the product unsafe, unfit for purpose, or significantly different from its description. For major failures, you choose the remedy: a full refund, or a replacement product of the same type and value.
8.2 Minor Failures
For minor failures (issues that can be repaired within a reasonable time), we may choose to repair the product free of charge, replace the product, or refund the purchase price.
8.3 Change of Mind Returns
We are not legally required to accept returns for change of mind. However, as a gesture of goodwill, we offer a 14-day change of mind return policy, subject to the conditions set out in our Refund and Return Policy.
We do not and will never display “No Refunds” signage or policies. Such statements are unlawful under the ACL. Customers always retain their statutory rights to remedies for faulty, defective, or misdescribed goods regardless of any store policy.
9. YouTube Channel and Digital Content
9.1 Scope
These Terms also govern your access to and use of our YouTube channel, worship videos embedded on our website, and any other digital content we produce and distribute (“Digital Content”).
9.2 Licence to View
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view our Digital Content for personal, non-commercial purposes only. This licence does not include the right to download (except where a download feature is expressly provided), reproduce, distribute, modify, publicly perform, or create derivative works from our Digital Content.
9.3 Worship Videos
Our worship videos are produced for inspirational and devotional purposes. They may contain original music, licensed worship music, scripture readings, and visual content. The inclusion of worship content does not constitute theological instruction, pastoral counselling, or any form of professional religious advice.
Music in our worship videos is either original compositions created by us, works in the public domain, or content we are otherwise authorised to use. You may not extract, re-record, or redistribute any music or audio content from our worship videos without obtaining your own appropriate permissions from the relevant rights holders.
9.4 YouTube Platform Terms
When you access our content via YouTube, you are also subject to YouTube’s Terms of Service, Community Guidelines, and Google’s Privacy Policy. We are not responsible for YouTube’s platform policies, algorithms, or any changes YouTube makes to the availability of our content.
9.5 User Comments and Interaction
We welcome respectful engagement on our YouTube channel and website. We reserve the right to moderate, remove, or disable comments that are offensive, discriminatory, harassing, spam, or otherwise inappropriate. By posting a comment on our YouTube channel or website, you grant us a non-exclusive, royalty-free licence to display that comment in connection with our content.
10. Intellectual Property
All content on our website and YouTube channel, including but not limited to text, graphics, logos, images, designs, videos, worship content, music arrangements, and software, is the intellectual property of Atelia: For Glory and For Beauty or its licensors and is protected by the Copyright Act 1968 (Cth) and international copyright laws.
Our Christian-inspired designs, scripture-based artwork, worship video productions, and brand elements are original works. You may not reproduce, distribute, or commercially exploit any content from our website or YouTube channel without our express written permission.
11. Limitation of Liability
To the maximum extent permitted by law (and subject always to the consumer guarantees under the ACL, which cannot be excluded), our total liability to you for any claim arising from or in connection with these Terms, your use of our products, website, or Digital Content shall not exceed the purchase price of the relevant product(s), or $100 AUD for claims unrelated to product purchases.
We are not liable for any indirect, consequential, or incidental loss or damage, except where such liability cannot be excluded by law.
We are not liable for any loss, damage, or injury arising from your reliance on the religious, inspirational, or devotional content in our products, website, or Digital Content.
12. Electronic Communications and Marketing
By providing your email address and opting in to receive marketing communications, you consent to receive promotional emails from us in accordance with the Spam Act 2003 (Cth). Every marketing email will identify our business and contain a functional unsubscribe facility. You may opt out at any time by clicking the unsubscribe link, and we will action your request within 5 business days.
We will not send you unsolicited commercial electronic messages without your express or inferred consent as defined by the Spam Act 2003.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of South Australia, Australia. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of South Australia, Australia.
For international customers: while these Terms are governed by Australian law, this does not affect any mandatory consumer protection rights you may have under the laws of your own country.
14. Dispute Resolution
If you have a concern or dispute, please contact us first at support@ateliaministry.com. We will endeavour to resolve the issue promptly and fairly.
If we are unable to resolve the matter directly, you may contact your relevant state or territory consumer protection agency, or the Australian Competition and Consumer Commission (ACCC) at www.accc.gov.au.
15. Unfair Contract Terms Compliance
We are committed to ensuring that our terms and conditions are fair, transparent, and comply with Part 2-3 of the Australian Consumer Law regarding unfair contract terms.
We confirm that our standard form contracts do not contain terms that would cause significant imbalance in the parties’ rights and obligations, are not reasonably necessary to protect our legitimate interests, or would cause detriment to a consumer or small business if relied upon.
We do not impose unfair cancellation fees, use automatic renewal clauses without clear disclosure, include terms allowing us to unilaterally change agreements after an order is confirmed, or restrict consumers’ rights to a remedy under the ACL consumer guarantees.
16. Amendments
We may update these Terms from time to time. The current version will always be available on our website with the effective date noted at the top. Continued use of our website or Digital Content after changes constitutes acceptance of the updated Terms.
